History of Gambling in Vietnam
Gambling has always been around in Vietnam, and it has almost always been prohibited. This became especially true when the country found itself under the Communist rule. Communism prohibited all kinds of gambling, because this type of entertainment is viewed as unwanted capitalism feature. Therefore, until the end of the 20th century, the only legal type of gambling was national lottery.
After communist regime was replaced with socialist one, the strict rules were amended, and due to a row of economic and political reforms, Vietnam turned from a stagnating country into one of the fastest growing economies in Asia. Socialist government did what Communist government failed to do - they eventually acknowledged that illegal gambling still existed.
Trying to manage illegal gambling, the state decided to legalize it - at least partially. First and foremost, they raided illegal locations where punting took place. In process, ironically, they had to arrest several government officials. Next, illegal operators faces years in jail for unlicensed and prohibited business. As estimated, illegal punting market in the country was worthy of some billion dollars. However, already by 2018, the state managed to cope with the majority of uncertified operators, and provided strict rules for market operation.
Current Situation on Gambling in Vietnam
Vietnamese are incredibly resourceful when it comes to Vietnamese gambling games. There are dozens of traditional entertainments that are enjoyed until today - for example, cockfighting, or even Siamese fish fighting. Modern and globally popular activities, like betting on soccer, and also widely enjoyed. However, it has to be underlined that there are cases when citizens were arrested or fined for making bets - even small ones, simply for fun - on any uncertified games. So, you have to be really careful about it.
Now, offline punting at brick and mortar casinos was legalized in 2017. However, there are only eight certified casinos, and they are open mostly for foreigners - more specifically, for holders of passport by any other country but Vietnam. Local residents are also allowed to make bets in offline facilities - but only when they are 21 years old and older, have an income of 10 million dong ($440) per month, pay entry tax, and have a written permission of their family members (more on this below). Also, people with criminal record are not allowed into a casino.
In 2018, the state legalized sports betting and animal races betting. Since then, the Vietnamese have been allowed to place bets on horse and greyhound racing, plus, on international football matches.
Talking about real money online casinos, there are no actual laws, or authorities, that would regulate them. There are no Vietnam online casinos run by local operators, obviously. So, theoretically, locals can play at international casino sites - like trusted online casino Malaysia, and these are not blocked by the state. However, there are cases when locals are arrested for wagering real money at Vietnam online casinos run from abroad. So, it is fifty-fifty chance, and because of that, most users hide their IP address and use VPN to stay safe. It is not clear, however, whether foreigners in Vietnam are allowed to play games at offshore web casinos, even if this is online casino Singapore legal.
As you can see, some gambling is legalized, but the general atmosphere is rather restrictive for the market. This is especially true for native Vietnamese. So, those who can afford it tend to travel to the neighboring countries - namely, Cambodia or Macau, or look for gambling in Thailand - to enjoy the casinos and make bets without those restrictions.
Vietnam Gambling Laws
From the legal point of view, there are only four legally allowed gambling activities in Vietnam. They are:
- land based Vietnam casino
- horse race betting
- greyhound race betting
- national lottery (which is a state-owned monopoly)
Overall, gambling is monopolized by the state. National lottery was in fact the only legal form from 1999 to 2017. And even after 2017, all businesses are under severe control. Two new Decrees - No. 06/2017/ND-CP and 03/2017/ND-CP - enabled sports betting and offline casinos for locals.
Now, as we have already mentioned, the law demands that local who would like to play at a brick and mortar casino in Vietnam has to be 21 years of age or older, earn at least VND 10 million ($440) a month, and buy an admission ticket - either daily or monthly entry. Moreover, the player has to provide a written permission from the family members that states he or she is allowed to make real money bets - because, as we remember, Vietnamese are extremely passionate about punting. Also also, family members can directly contact any operator and and provide a written prohibition where they state they do not allow their family member to play real money games.
For foreigners, the rules are simpler - the foreigner has to provide a valid passport, and have a legitimate entry permission to the country.
Online gambling is basically unregulated, and the players can access offshore casino sites, but only at their own risk. The state does not seem to blacklist and block casinos, or prohibit bank transactions. Instead, the general rule is that losing or winning more than VND 10 million online is illegal. The player caught for the first time will be fined for VND 50 million, if caught for the second time - either face a fine of VND 100 million, or jail time from 6 months to 3 years.
Regulatory Authorities in Vietnam
There are currently no special regulatory authorities as such that would control the gambling market. So, the scheme of control and regulation is currently not really clear. However, the offline venues pay taxes and are required to oblige a set of rules and regulations, while players who violate the rules stated by the Decrees are to face fines and / or prison. Hopefully, with time, the state will create a separate agency that would collaborate with the gambling market on more transparent basis.
Taxation Laws on Gambling in Vietnam
While the businesses pay considerable taxes to the government, the players are not expected to pay any tax on their winnings - at least this rule works in Vietnam for now. Neither brick and mortar casino winnings, nor winnings from other legal punting entertainments are not expected to be taxed. The state actually offered to provide 10% tax on winnings - and some tax is actually withheld at the source when talking about national lottery - but the government eventually decided that taxes would deter the foreigners and can impact tourism attraction.
